WARRANTY for use of the VitaScale System

General information

VitaScale GmbH and its affiliates („VitaScale“) grants the following manufacturer’s warranty, which applies only to the VitaScale System (hereinafter collectively referred to as the „VitaScale System“) for indoor use. Any other use of the VitaScale System will void or render inapplicable this manufacturer’s warranty.

 

This manufacturer’s warranty is the exclusive warranty of VitaScale and supersedes all prior warranties, contrary or otherwise. This warranty is limited to the duration of the warranty periods specified below. Your contractual or statutory warranty rights against the respective seller are not affected or limited by this manufacturer’s warranty.

 

During the warranty periods described below, the covered components of the VitaScale System are free from defects or malfunctions under normal use. Certain exclusions apply as described in this manufacturer’s warranty. The manufacturer’s warranty applies only to the following components of the VitaScale System for the period specified. The manufacturer’s warranty applies only to defects that have occurred within the applicable warranty periods and only as long as the VitaScale System remains in the possession of the original purchaser or, in the case of VitaScale Systems that have been given away, in the possession of the owner of the original subscription accompanying such VitaScale System.

Battery: 12 MONTHS

VitaScale warrants the battery to be free from defects in workmanship and materials for a period of 12 months from the date of original shipment.

Sensors: 2 YEARS

VitaScale warrants the frame of the VitaScale system (excluding moving parts attached to the frame) to be free from defects in workmanship and materials for a period of 2 years from the date of original shipment.

VitaScale warrants the sensors of the VitaScale system to be free from defects in workmanship and materials for a period of 2 years from the date of original shipment.

Plastic components: 2 years

VitaScale warrants the components and all original plastic component parts supplied with the VitaScale system to be free from defects in workmanship and materials for a period of 2 years from the date of original shipment. Ear Pads, Adapters and Filters are not warranted against normal wear and tear and it is important that you periodically inspect the plastic components for damage, loose parts or other signs of wear that may cause failure or partial failure. Please refer to VitaScale’s instructions for maintaining your VitaScale system, available on VitaScale’s website.

INSTALLATION: 12 MONTHS

For VitaScale systems originally trained by an authorized VitaScale employee, VitaScale will pay the labor cost of repair or replacement under this limited warranty for a period of 12 months from the date of original shipment. If the VitaScale system or any warranted components must be returned to a VitaScale service facility for repair, VitaScale will pay all shipping costs during the warranty period. Repair and shipping charges will not be covered for locations where VitaScale originally trained the VitaScale system or if the VitaScale system was taken to a location outside of VitaScale’s service area.

EXCLUSIONS AND LIMITATIONS

Who and what is covered:

The original owner of the VitaScale System. The VitaScale System must remain in the possession of the original purchaser or, in the case of VitaScale Systems given as a gift, in the possession of the owner of the original subscription accompanying such VitaScale System. This manufacturer’s warranty is not transferable.

 

If a defect occurs in the VitaScale System or any warranted component within the applicable warranty period, the purchaser’s sole and exclusive remedy shall be, at VitaScale’s option, to either replace or repair the defective or faulty VitaScale System or affected components with the same or a comparable model. Any replacement or repaired component shall be warranted for the remainder of the original warranty period or 30 days, whichever is longer.

What is NOT covered by the warranty:

Any other VitaScale products or VitaScale services, non-VitaScale products or non-VitaScale labor, products that are stolen or counterfeit or that VitaScale has reason to believe were purchased from an unauthorized dealer or reseller, products purchased or used outside the territories that VitaScale serves in Germany, and products with missing or defaced serial numbers.

 

Software, even if sold with or incorporated into the VitaScale system, or a working internet connection. VitaScale does not warrant that the operation of the VitaScale system will be uninterrupted or error free.

 

Damage or equipment failure due to normal wear and tear, improper or negligent assembly, maintenance, installation, relocation or repair (other than by an authorized VitaScale service technician), use of the VitaScale system with third party parts or accessories or with parts or accessories not originally intended for or compatible with the VitaScale system, or use contrary to the instructions in this manual.

 

Damage or equipment failure due to accident, misuse, abuse, neglect, corrosion, discoloration of paint or plastic (or any other change in cosmetic appearance that does not affect performance), theft, vandalism, fire, flood, wind, lightning, frost or other natural disaster or act of God of any kind, electrical wiring, reduction in power, power fluctuation or failure regardless of cause, unusual weather conditions, collision, introduction of foreign objects or modifications not approved or recommended by VitaScale.

 

VitaScale shall not be responsible or liable for any indirect, special, incidental, or consequential damages, economic loss, loss of property or profits, loss of leisure time or loss of use, or other consequential damages of any kind in connection with the purchase, use, repair, or maintenance of any equipment or parts. VitaScale will not provide financial or other compensation for any such repair or replacement costs, including but not limited to gym membership fees, lost work time, replacement equipment costs, diagnostic visits, maintenance visits, or transportation.

 

Equipment used for commercial purposes or for purposes other than single family household or household use.

FURTHER INFORMATION

Any attempt to modify or repair VitaScale systems creates the risk of personal injury and property damage. VitaScale is not responsible or liable for any damage or injury caused during or as a result of any movement, repair or attempted repair of equipment by anyone other than a VitaScale authorized service technician. Any moves or repairs made by you or your representatives are at your own risk, and VitaScale shall not be liable for any personal injury or property damage resulting from such moves or repairs. Replacement equipment, parts and electronic components that have been refurbished by VitaScale or its suppliers may be supplied as warranty replacements and constitute fulfillment of the terms of the warranty.

HOW TO OBTAIN WARRANTY SERVICE

Service under this manufacturer’s warranty is only available by contacting the Customer Service Team at service@vitascale.de. You will be asked to provide VitaScale with the serial number of your VitaScale system and the dated receipt or other proof of purchase indicating the date of purchase as soon as you discover a nonconformity or defect. Claims must be made within the stated warranty period.

WHAT WE WILL DO TO REMEDY WARRANTED DEFECTS.

In the event of any defect in the components or VitaScale System covered by this warranty, VitaScale will ship to you any new or repaired parts or components or, at its option, replace the VitaScale System. All replacement parts are warranted for the remaining portion of the original warranty period. The place of performance of the warranty is limited to the areas served by VitaScale in Germany.

Any dispute between you and VitaScale in connection with this Limited Warranty or the VitaScale System shall be subject to the then-current dispute resolution procedures in VitaScale’s Terms and Conditions, which are available at: www.VitaScale.de/agbs.

 

It is very important that you read the User Manual before using your VitaScale System. Remember to perform regular maintenance and service as outlined in the user manual to ensure proper operation of the VitaScale system.

 

This manufacturer’s warranty is subject to the laws of the Federal Republic of Germany.
